1. Definitions

For the purposes of these Terms and Conditions, the following terms shall have the following meanings:

      • Buyer – a natural person, legal entity, or organizational unit without legal personality but with legal capacity, using the Store, in particular making purchases;
      • Consumer –a natural person concluding a contract with the Seller not directly related to their business or professional activity;
      • Payment Processor:

      • Creator – Agnieszka Janczewska, creator of electronic products, author of books, and leader of sessions and workshops sold through the Store.

2. Introductory Provisions

      1. Through the Store, the Seller provides the Buyer with the opportunity to conclude a sales contract for physical products available in the Store, a contract for the supply of digital content in the form of electronic products described on the Store’s websites, and a contract for participation in individual sessions or workshops in accordance with the information provided in the Store. The Terms and Conditions define the terms and conditions of using the Store, as well as the rights and obligations of the Seller and the Buyer.
      2. To make a purchase through the Store or to use electronic products purchased through the Store, the Buyer’s computer or other device does not need to meet any specific technical requirements. The following are sufficient:
        – Internet access,
        – a standard operating system,
        – a standard web browser such as Internet – Explorer, Google Chrome, Mozilla Firefox, Opera, Safari,
        – a standard PDF viewer (e.g., Adobe Reader),
        – a valid email address.
      3. To participate in the session, you must have a working telephone capable of making and receiving voice calls or a device equipped with the WhatsApp or Skype application and connected to the internet.
      4. The Buyer cannot make a purchase anonymously or under a pseudonym.
      5. It is prohibited to provide illegal content when using the Store, in particular by sending such content via forms available in the Store.
      6. All product prices listed on the Store’s websites are gross prices.

 

3. Services provided electronically

      1. Through the Store, the Seller provides services to the Buyer electronically.
      2. The primary service provided electronically to the Buyer by the Seller is enabling the Buyer to place an order in the Store. Placing an order requires a Store account.
      3. The Seller also provides the Buyer with an electronic service consisting of creating and maintaining an account in the Store. The account stores the Buyer’s data and the history of orders placed in the Store. The Buyer logs in to the Account using their email address and a password of their choosing.
      4. Creating an account in the Store is done by checking the appropriate checkbox during the ordering process. The Buyer may delete the account at any time by sending a request to the Seller. Deleting the account will not delete the data on orders placed using the account.
      5. The services referred to in paragraphs 2, 3, and 4 above are provided to the Buyer free of charge.
      6. However, contracts for the supply of digital content, product sales contracts, and service contracts concluded through the Store are subject to a fee.
      7. To ensure the security of the Buyer and the transfer of data in connection with the use of the Store, the Seller takes technical and organizational measures appropriate to the level of security risk associated with the services provided, in particular measures to prevent the acquisition and modification of personal data by unauthorized persons.
      8. The Seller takes steps to ensure the proper functioning of the Store. The Buyer should inform the Seller of any irregularities or interruptions in the operation of the Store.
      9. The Buyer may submit any complaints regarding the operation of the Store via email to info@liveyourlifeconsciously.com. In the complaint, the Buyer should provide their name, mailing address, as well as the type and date of the irregularity related to the operation of the Store.

4. Intellectual property rights

      1. The Seller hereby informs the Buyer that electronic products available in the Store constitute works within the meaning of the Act of 4 February 1994 on Copyright and Related Rights, to which the copyright belongs to the Author, and the Seller is entitled, under a license, to undertake activities related to the sale of electronic products through the Store, including granting the Buyer a license under the terms specified in paragraphs 2-4.
      2. Upon conclusion of the agreement for the supply of digital content in the form of electronic products, the Seller grants the Buyer a non-exclusive, non-transferable license to use the electronic product purchased by the Buyer. The license is granted for an indefinite period, without territorial restrictions. The Buyer may download each electronic product any number of times and save it on the Buyer’s devices if it meets the technical requirements specified in paragraph 2, section 3. However, the Seller does not guarantee or provide the technical capabilities to download and save the electronic product on any type of device, particularly if the requirements referred to above are not met. The Buyer is also entitled, under the license, to print out the text of the electronic product. The Buyer’s rights include only those expressly specified in the license; the Buyer may not infer or assume any rights that do not arise directly from the license or mandatory provisions of law.
      3. The Seller instructs the Buyer that the Buyer is authorized to use the electronic product only to the extent specified in the license and legal provisions regarding permitted personal use. Further distribution of electronic products by the Buyer without the Seller’s consent constitutes an infringement of the copyright of the Creator or Seller in electronic products and may result in civil or criminal liability. The Buyer is not authorized to grant further licenses (sublicenses). Subject to mandatory provisions of law, the Buyer is specifically prohibited from distributing or making available the electronic product, copies, or printouts thereof, from using the electronic product for commercial purposes, or from making changes or modifications to the electronic product. The Buyer should ensure that no unauthorized person uses the electronic product purchased by them.
      4. The Seller may terminate the license in the event of a breach of the license terms by the Buyer and in cases specified by law, subject to a 30-day notice period. The Seller also reserves the right to terminate the license upon expiration of the Seller’s license, of which the Seller will notify the Buyer.

5. Placing an order

      1. Placing an order requires the Buyer to have a user account. The Buyer can only create an account when placing the order.
      2. If the Buyer has an account in the Store, they should log in before placing an order. Logging in is also possible while placing an order.
      3. In order to place an order, the Buyer is obliged to take the following steps:
        • select the physical or electronic product or service that is the subject of the order (session or workshop) by clicking the “Add to cart” button, then the Buyer will be automatically transferred to the cart view (in the case of randomly sent messages from the Store, adding to the cart is done by randomly selecting messages from among the groups available on the website and then clicking the “You will receive the content after making the payment” button),
        • from the basket view, click the “Proceed to checkout” button,
        • log in to your account in the Store, and if the Buyer does not have an Account yet, he or she is obliged to complete the order form, providing all the data necessary to complete the order, and an account will be created,
        • select the payment method for the order and submit an appropriate declaration by checking the checkboxes, including accepting the Regulations (acceptance of the Regulations is voluntary, but necessary to place an order),
        • click the “Place an order” button
      4. After clicking the “Place an order” button, the Buyer will be redirected to the Payment Operator’s website to pay for the order. After successful payment, the Buyer will be redirected back to the Store’s website with an order confirmation. At this point, the contract is deemed concluded between the Buyer and the Seller. Confirmation of the contract and a VAT invoice will be sent to the Buyer to the email address provided in the order form.
      5. After logging in to their account, the buyer will be able to view the orders they have placed.
      6. Depending on the subject of the order, a specific type of contract may be concluded between the Buyer and the Seller:
        • in the case of physical products – sales contract,
        • in the case of electronic products – a contract for the supply of digital content,
        • in the case of sessions and workshops – a service contract.
      7. If the subject of the order includes products or services of different types, placing an order leads to the conclusion of several contracts of a specific type corresponding to the subject of the order.
      8. The Buyer must provide accurate personal data in the order form. The Buyer is responsible for providing false personal data. The Seller reserves the right to suspend order processing if the Buyer provides false data or if such data raises reasonable doubts as to its accuracy. In such a case, the Buyer will be informed by phone or email of the Seller’s concerns. In such a situation, the Buyer has the right to clarify all circumstances related to verifying the accuracy of the provided data. In the absence of data enabling the Seller to contact the Buyer, the Seller will provide all necessary clarifications after the Buyer has contacted them.
      9. The Buyer declares that all data provided by him in the order form is true, but the Seller is not obliged to verify their truthfulness and correctness, although he has such right in accordance with paragraph 10 above.

6. Delivery and payment

      1. Available delivery methods for orders involving physical products are presented to the Buyer at the ordering stage.
      2. The available payment methods for the order are described on the Store’s website and presented to the Buyer at the stage of placing the order.
      3. The cost of delivery of the order is borne by the Buyer, unless the Seller indicates otherwise on the Store’s website.
      4. Electronic payments, including card payments, are handled by the following payment operators:

7. Electronic products

      1. An order for electronic products is fulfilled by sending a message to the e-mail address provided by the Buyer in the order form containing instructions on how to download or gain access to the purchased electronic product.
      2. When ordering books in .pdf format or audiobooks, the Buyer will receive a message from the Seller containing a link. Clicking the link will allow the Buyer to download the book in their chosen format.

8. Vouchers

      1. The Store offers two types of vouchers: a horoscope voucher and a session voucher. A voucher can be used once by the recipient as a payment method for an order placed through the Store for a horoscope or session. Redemption of a voucher involves entering the voucher code in the appropriate field during the ordering process, which replaces cash payment.
      2. The voucher is valid for 30 days from the date of purchase. This means that during this period, the voucher can be used in the manner described in paragraph 1 above. After the voucher’s validity period expires, it will no longer be redeemable. Unused vouchers are not eligible for a refund.
      3. After the Buyer places an order for a voucher, the Seller will send the Buyer a message enclosing the ordered voucher and providing the information necessary to use it. The Buyer may give the voucher to any person of their choice. In such a case, the Buyer is obligated to provide that person with all the information necessary to use the voucher.
      4. The person who used the voucher, after placing the order, must go through the procedure of setting the session date in accordance with the provisions of § 10 of the Regulations, with the proviso that if the session does not take place within 30 days of placing the order, the person using the voucher or the Buyer who originally purchased the voucher is not entitled to use the voucher again or to a refund of the price paid when purchasing the voucher.

9. Physical products

      1. Fulfillment of an order for physical products takes place by shipping the purchased physical products to the address provided by the Buyer.
      2. The order processing time should not exceed 14 days, unless otherwise stated in the product description in the Store.
      3. The order is considered completed when the shipment is sent to the Buyer.
      4. The shipment should be delivered to the Buyer within the time specified in the chosen delivery method.

10. Sessions

      1. The sessions are led by the Creator and take place via telephone or WhatsApp in Polish or English, and the duration of one session is a maximum of one hour.
      2. The order for a session is fulfilled by the Seller sending a message to the Buyer indicating the dates on which the session can take place.
      3. After selecting a suitable delivery date, the Buyer is obligated to notify the Seller. In the message to the Seller, the Buyer should indicate the preferred means of communication.
      4. After receiving a message from the Buyer indicating the date selected by the Buyer, the Seller will reserve this date for the Buyer and send him a message confirming the reservation of the date selected by the Buyer.
      5. The buyer has the option to change the previously scheduled session date once. This change can be made no later than three days before the session was scheduled.
      6. However, if, for reasons beyond the control of the Seller and the Buyer, difficulties arise in determining a suitable date, resulting in the session not taking place within 30 days of the date on which the Buyer placed the order, the Buyer may withdraw from the contract by sending an appropriate email to the Seller. In the event of withdrawal by the Buyer, the Seller will refund the Buyer any fees paid to the Seller for the session at the time of placing the order.
      7. The session is conducted in accordance with the description provided on the Store’s website. The Buyer’s subjective impressions regarding the session, in particular their dissatisfaction with the information provided during the session, do not entitle the Buyer to a refund of the session fee, nor do they give rise to any other claims on the Buyer’s part, except for claims arising from the Seller’s liability under the general principles described in the Civil Code.
      8. In order to participate in a session, the Buyer is required to connect with the Creator at the scheduled session time, via their chosen means of communication. The Seller is not responsible for technical issues attributable to the Buyer.
      9. Failure to participate in the session by the Buyer, except in the event that the Buyer who is a Consumer has effectively withdrawn from the contract or the contract has been terminated by mutual consent, does not entitle the Buyer to a refund of the fee paid to the Seller for participation in the session.
      10. Horoscopes available in the Seller’s offer are implemented according to the principles regarding sessions described above.

11. Workshops

      1. The order for stationary workshops is fulfilled by providing the Buyer or a person indicated by the Buyer in accordance with paragraph 6 below with the opportunity to participate in the workshops on a date agreed jointly with the Buyer.
      2. The workshops are conducted personally by the Creator and are carried out in accordance with the description on the Store’s website.
      3. To participate in the workshops, the Buyer or a person designated by the Buyer is required to appear at the workshop location on the date agreed upon with the Seller. Travel costs to the workshop location and any accommodation costs are the responsibility of the Buyer or the person designated by the Buyer participating in the workshops.
      4. Failure to participate in the workshops by the Buyer or a person indicated by him, except for a situation in which the Buyer who is a Consumer has effectively withdrawn from the contract or the contract has been terminated by mutual consent within the period specified in § 5 section 6, does not entitle the Buyer to a refund of the remuneration paid to the Seller for participation in the workshops, nor does it give rise to any other claims on the part of the Buyer, except for claims arising from the Seller’s liability under the general principles described in the Civil Code.
      5. If the Seller organizes in-person workshops on multiple dates, the Buyer may change the date on which they will participate in the workshops if they notify the Seller at least 10 days before the workshop date specified in the Buyer’s order, and the Seller is able to provide the Buyer with the opportunity to participate in the workshops on a different date. Otherwise, changing the date is not possible, and failure to participate in the workshops will result in the consequences referred to in paragraph 4 above.
      6. When purchasing workshops, the Buyer has the right to designate a person to participate in the workshops. In such a case, the Buyer is obligated to provide the workshop participant’s details within two days of concluding the contract. The Buyer may change the workshop participant’s details no later than 10 days before the workshop date.
      7. The Buyer’s subjective feelings regarding the course of the workshops, in particular the Buyer’s dissatisfaction with the information provided to him during the workshops, do not entitle the Buyer to demand a refund of the remuneration paid for the workshops, nor do they give rise to any other claims on the part of the Buyer, except for claims arising from the Seller’s liability under the general principles described in the Civil Code.

12. Consumer withdrawal from the contract

      1. A consumer who has concluded a distance contract with the Seller has the right to withdraw from the contract without giving any reason within 14 days from the date of taking possession of the purchased items (in the case of a sales contract) or within 14 days from the date of conclusion of the contract (in the case of a contract for the supply of digital content and a contract for the provision of services).
      2. The right to withdraw from the contract does not apply to contracts:
        • for the provision of services, if the Seller has fully performed the service with the express consent of the Consumer, who was informed before the commencement of the service that after the Seller has performed the service, he will lose the right to withdraw from the contract,
        • for the supply of digital content that is not recorded on a tangible medium, if the performance of the service has begun with the express consent of the Consumer before the expiry of the withdrawal period and after the Seller has informed the Consumer of the loss of the right to withdraw from the contract.
      3. The moment of commencement of performance in the case of electronic products is the delivery to the Buyer of an e-mail with instructions for obtaining access to the electronic product.

      5. To withdraw from the contract, the Consumer must inform the Seller of his decision to withdraw from the contract by means of an unequivocal statement – ​​for example, a letter sent by post, fax or e-mail.
      6. In order to meet the deadline for withdrawal from the contract, it is sufficient for the Consumer to send information concerning the exercise of the Consumer’s right to withdraw from the contract before the deadline for withdrawal expires.
      7. The consumer is obligated to return the product to the Seller or hand it over to a person authorized by the Seller to collect it immediately, but no later than 14 days from the date on which they withdrew from the contract, unless the Seller has offered to collect the item themselves. To meet the deadline, it is sufficient to return the product before its expiry.
      8. The consumer bears the direct costs of returning the goods.
      9. In the event of withdrawal from the contract, the Seller will refund all payments received from the Consumer, including the cheapest shipping cost available in the Store (if the Consumer covered the cost), immediately, and in any case no later than 14 days from the date on which the Seller was informed of the exercise of the right of withdrawal. The refund will be made using the same payment method that the Consumer used in the original transaction, unless the Consumer expressly agrees to a different solution. In any case, the Consumer will not incur any fees in connection with this refund method.
      10. If the Seller has not offered to collect the goods from the Consumer himself, he may withhold the reimbursement of payments received from the Consumer until he receives the goods back or the Consumer provides proof of sending them back, whichever occurs first.
      11. The consumer is liable for any reduction in the value of the product resulting from using the product in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the product.

13. Liability for defects

      1. The Seller is obliged to deliver the product and digital content to the Buyer free from defects.
      2. Sprzedawca jest odpowiedzialny względem Kupującego, jeżeli sprzedany produkt lub treść cyfrowa ma wadę fizyczną lub prawną (rękojmia za wady).
      3. Jeśli Kupujący stwierdzi wadę produktu lub treści cyfrowej, powinien poinformować o tym Sprzedawcę, określając jednocześnie swoje roszczenie związane ze stwierdzoną wadą lub składając oświadczenie stosownej treści.
      4. Kupujący może skorzystać z formularza reklamacyjnego, stanowiącego Załącznik nr 1 do umowy, jednak nie jest to obowiązkowe.
      5. Kupujący może kontaktować się ze Sprzedawcą zarówno pocztą tradycyjną, jak również pocztą elektroniczną.
      6. Sprzedawca ustosunkuje się do składanej przez Kupującego reklamacji w ciągu 14 dni od dnia doręczenia mu reklamacji za pomocą takiego środka komunikacji, przy wykorzystaniu którego reklamacja została złożona.
      7. Sprzedawca poucza Kupującego, że treść produktów elektronicznych stanowi jedynie przekaz wiedzy i doświadczeń Twórcy, nie stanowi ona wskazówek i wytycznych do podejmowania przez Kupującego działań lub zaniechania działań. Celem produktów elektronicznych jest umożliwienie Kupującemu spojrzenia na rzeczywistość w innym, nowym świetle. Kupujący wszelkie decyzje podejmuje na własną odpowiedzialność, a odpowiedzialność Sprzedawcy bądź Twórcy jest w tym zakresie, w granicach dopuszczalnych prawem, wyłączona.
      8.       2. Administratorem danych osobowych Kupującego jest Sprzedawca.
      3. Dane osobowe Kupującego są przetwarzane w celu obsługi konta użytkownika, realizacji zamówienia, kontaktu z Kupującym oraz ewentualnej obrony, dochodzenia lub ustalenia roszczeń związanych z zawieranymi za pośrednictwem Sklepu umowami sprzedaży. 15. Pozasądowe sposoby rozpatrywania reklamacji i dochodzenia roszczeń

      1. Sprzedawca wyraża zgodę na poddanie ewentualnych sporów wynikłych w związku z zawartymi umowami na drodze postępowania mediacyjnego. Szczegóły zostaną określone przez strony konfliktu.
      2. Konsument ma możliwość skorzystania z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń. Między innymi, Konsument ma możliwość:
        • zwrócenia się do stałego polubownego sądu konsumenckiego z wnioskiem o rozstrzygnięcie sporu wynikłego z zawartej umowy,
        • zwrócenia się do wojewódzkiego inspektora Inspekcji Handlowej z wnioskiem o wszczęcie postępowania mediacyjnego w sprawie polubownego zakończenia sporu między Kupującym a Sprzedawcą,
        • skorzystania z pomocy powiatowego (miejskiego) rzecznika praw konsumenta lub organizacji społecznej, do której statutowych zadań należy ochrona konsumentów.
      3. Bardziej szczegółowych informacji na temat pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń, Konsument może szukać na stronie internetowej http://polubowne.uokik.gov.pl.
      4. Konsument może również skorzystać z platformy ODR, która dostępna jest pod adresem http://ec.europa.eu/consumers/odr. Platforma służy rozstrzyganiu sporów pomiędzy konsumentami i przedsiębiorcami dążącymi do pozasądowego rozstrzygnięcia sporu dotyczącego zobowiązań umownych wynikających z internetowej umowy sprzedaży lub umowy o świadczenie usług.

16. Postanowienia końcowe

      1. Sprzedawca zastrzega sobie prawo do wprowadzania oraz odwoływania ofert, promocji oraz do zmiany cen produktów w Sklepie bez uszczerbku dla praw nabytych przez Kupującego, w tym w szczególności warunków umów zawartych przed dokonaniem zmiany.
      2. Sprzedawca zastrzega sobie możliwość wprowadzania zmian w Regulaminie. Do umów zawartych przed zmianą Regulaminu stosuje się Regulamin obowiązujący w dacie zawarcia umowy.
      3. Kupujący o każdej zmianie Regulaminu zostaną powiadomieni pocztą elektroniczną na adres e-mail przypisany do konta. W przypadku braku akceptacji treści nowego Regulaminu, Kupujący ma prawo w każdym czasie wypowiedzieć umowę o prowadzenie konta poprzez zgłoszenie Sprzedawcy zlecenia usunięcia konta lub złożenie Sprzedawcy stosownego oświadczenia, w dowolnej formie, o wypowiedzeniu umowy o prowadzenie konta.
      4. W sprawach nieuregulowanych w Regulaminie, o ile przepisy bezwzględnie obowiązującego prawa nie stanowią inaczej, mają zastosowanie przepisy prawa polskiego.
      5. Niniejszy Regulamin obowiązuje od dnia 06.2019
      6. Wszystkie archiwalne wersje Regulaminu dostępne są do ściągnięcia w formacie .pdf – linki znajdują się poniżej Regulaminu.
      7. Regulamin został stworzony w dwóch wersjach językowych polskiej i angielskiej. Obowiązujący jest Regulamin w języku polskim, wersja angielska służy wyłącznie celom informacyjnym.

Teacher that feels

I started working on my methodology 13 years ago when no existing methods could help me find relief from a life-long depression. I healed myself by untangling my mind and getting aware of the feelings that come from my heart.

Since then, I shared my knowledge with people who used it to overcome major depressive episodes, suicidal thoughts, addictions, eating disorders, and even physical diseases.

My journey showed me that transformation can happen only if you work with yourself.

That’s why I call myself a teacher, not a therapist. I pass knowledge and techniques that help you heal your body and mind from within.
